Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Zaapp platform, mobile application, and related services provided by Dustprints Solutions ("Company," "we," "us"). By creating an account or using Zaapp, you agree to be bound by these Terms.
1. Eligibility & Account Responsibilities
You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account. You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
2. Permitted Use & Acceptable Content
Zaapp provides AI-assisted content creation, multi-platform scheduling, and digital storefront creation for legitimate businesses, creators, and professionals. You agree NOT to use the platform to:
- Generate or disseminate defamatory, fraudulent, obscene, discriminatory, or unlawful content.
- Violate intellectual property rights, trademarks, or copyrights of any individual or entity.
- Distribute spam, automated mass harassment, or malicious software.
- Circumvent platform rate limits, quota controls, or attempt reverse engineering of Zaapp software.
3. Subscriptions, AI Tokens & Billing
- AI Tokens & Credits: Recharges grant digital AI tokens for generating copy, banners, videos, and catalog operations. Tokens are credited immediately upon confirmed payment.
- Pricing: All package prices are listed in Indian Rupees (INR) inclusive of applicable taxes, unless otherwise specified.
- Billing: Payments are processed via authorized payment gateways (PayU). You authorize recurring or one-time charges according to your selected plan.
4. Digital Storefronts, Marketplace Operations & Intermediary Safe Harbor (IT Act Sec 79)
Zaapp operates strictly as an intermediary electronic marketplace platform under Section 79 of the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020. Merchants hosting digital storefronts on zaappi.com/store/[slug] are independent business entities and sole sellers of their merchandise.
- Merchant Liability: Merchants are exclusively responsible for product listings, pricing, statutory warranties, quality guarantees, delivery fulfillment, invoicing, and post-sales customer care. Zaapp is neither an agent, retailer, nor distributor of any merchant's physical goods.
- Settlement & Escrow Mechanism: For consumer protection and prevention of fraud, online customer payments are held in a secure settlement holding ledger. Funds are disbursed to merchants after verified delivery and the expiration of a mandatory cooling / dispute window: 72 hours (3 days) for local deliveries and 7 calendar days (168 hours) for national 3PL / Shiprocket courier shipments.
- Customer Disputes & Return Liability: If a customer reports a damaged, non-delivered, or defective product within the applicable cooling window (72 hours local / 7 days courier), payout for the disputed transaction is immediately frozen. The merchant is legally required to resolve the issue with the buyer. Zaapp bears no liability for merchant refunds or product defects.
5. Intellectual Property
You retain full ownership of all original media, catalog assets, and branding materials uploaded to Zaapp. You grant Zaapp a non-exclusive license solely to process, host, and publish these assets at your direction. The Zaapp platform, AI algorithms, trademarks, and user interfaces remain the exclusive property of Dustprints Solutions.
6. Limitation of Liability
Zaapp is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Dustprints Solutions shall not be liable for any indirect, incidental, or consequential damages resulting from platform downtime, third-party API changes (Meta, LinkedIn, Google), merchant defaults, or loss of business data.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Uttar Pradesh / New Delhi, India.
